Silence Deepens: Sonam Wangchuk’s Wife Alleges No Communication, No Detention Order Copy

After Sonam Wangchuk's arrest, news broke out that no paper has been handed over to the family and no contact has been allowed with the detained person. His wife has seriously raised concerns about openness and legal procedures as no copy of the order and allowance for any kind of contact have been given.

Activist Held, Family Left in the Dark

Wangchuk, who has been praised for his numerous environmental projects in Ladakh and has been quite vocal in exercising the constitutional rights of the people of the area, was arrested under the Public Safety Act (PSA) about the middle of the week. Nevertheless, his wife insists that despite her multiple attempts both she and his legal team have been denied the official detention order for the purposes of it being viewed.

The wife disclosed that she felt the situation as "very worrying" and a breach of law. "No information about his safety, no idea about his place of detention, and no official documents have been shared," she said, enumerating the concerns of Wangchuk's detention accompanying the increasing tension of the case.

Legal Concerns Over PSA Use

Detaining under the Public Safety Act, in which the power to preemptively deprive a person of their freedom lies, has been the subject of criticism by legal experts and human rights activists. They reason that doing so while not handing over the legal paperwork would be tantamount to a weakening of the democratic ideals and hindering the access of the judiciary for oversight.

Wangchuk, a prominently praised figure for his innovative initiatives to promote sustainability and his active participation in Ladakh’s self-rule program, had been vocally concerned about the region’s natural environment and had been raising the issue of governance. Those who hold his arrest accountable to his protest activities and vocal criticism of the government policies are the majority.

The withholding of requisite information has caused an uproar amongst the non-governmental organizations, environmental activists, and leaders of the political movement. Demonstrations calling for the immediate liberation of Wangchuk and assuring that more openness be given have become more radical in different parts of Ladakh as well as beyond.
